Trion man arrested again for DUI after crashing into vehicle on parking lot in Chattooga County

According to a Georgia State Patrol incident report, On May 22nd, 2023, at 2:30 PM, Trooper Mosley responded to a two-vehicle accident in the parking lot of the Atrium Health Urgent Care off of Woodhaven Drive in Summerville. Trooper Mosley arrived on scene and was advised by the victim that the other driver of the 2001 Sequoia, Joshua Allen Bates, 40, of Trion, had walked into Urgent Care. Trooper Mosley reported, “While walking towards the Urgent Care entrance to attempt to make contact with the driver, a male matching the description given by the witness walked out. [I] made contact with Bates, who stated that he moved his vehicle so he could listen to music and did not mean to strike the other vehicle. While speaking with Mr. Bates, [I] could smell the strong odor of an alcoholic beverage emitting from his breath. He also had bloodshot and watery eyes. Mr. Bates stated that he did not have a license. [I] asked Mr. Bates if there was insurance on his vehicle and if he could provide me with an insurance card. While searching on the passenger side of the vehicle, a sealed Miller Lite beer bottle fell out onto the parking lot surface, causing it to open. Chattooga County Deputy Wilks then advised that there was at least one large can of alcohol open inside Mr. Bates’ vehicle that he could see while standing on the driver’s side. Mr. Bates was able to find his paper copy of his identification card and advised that his license had been suspended for prior DUI charges. When asked, Mr. Bates stated that he had consumed two 40oz cans of Bud Ice beer while parked in his original parking spot by the front door of the Urgent Care prior to moving his vehicle.” During field sobriety testing, Bates showed several signs of impairment and a BAC of .399 on a PBT. Bates was placed under arrest for DUI and refused the state test. Bates was transported to the Chattooga County Jail and charged with DUI and felony probation (original charge: sale of meth)
