Dalton woman arrested for DUI after 911 call from concerned citizen in Dalton

According to a Dalton Police Department incident report, on January 4th, 2023, at 11:49 PM, Officer Warren was dispatched to the intersection of North Glenwood Avenue and Legion Drive to the Circle k in reference to a damaged vehicle and a potential driver under the influence. The caller stated he was leaving Popeyes Chicken and observed a vehicle traveling southbound on Glenwood Ave that was missing its right front tire and was driving on its rim, causing sparks to be thrown off of the rim. The caller followed the vehicle down to Circle K, where the vehicle was stopped by the air pumps. The caller stated that a female stepped out of the vehicle and was having trouble keeping her balance. He stated that the female appeared to be trying to air up her rim at the air pump. The caller pointed the officer to the vehicle parked by the air pump was a white 2008 Ford Focus. Officer Warren then made contact with a female, later identified as Viry Arroyo Aguero, 24, of Dalton. Officer Warren reported, “Viry appeared to be having trouble balancing and was staggering as she walked. Viry was walking toward the vehicle that the caller had pointed out to me. Upon inspecting Viry’s vehicle, [I] noticed that her front right tire was no longer on the rim. [I] asked Viry what had happened to her tire. She did not answer. She then asked me if [I] was going to fix her tire or not. [I] informed her that [I] was not going to fix her tire. Viry’s speech was slow and slurred. her eyes were glazed over, and she was having trouble maintaining her balance even when she was standing still.” During field sobriety tests, Viry showed several signs of impairment and showed a BrAC of .258 on a PBT. Officers asked Viry what her full name was and her birth date, and she stated that she did not know. Inside the vehicle, officers located an open container of alcohol (Clubtails Margarita) was located in the front cup holder and appeared to be half empty. Officers also located an empty 50 ml whiskey bottle in the center console of the vehicle and an empty 375 ml whiskey bottle in Viry’s backpack, which was located behind the passenger seat with the backpack open. Viry was transported to the Whitfield County Jail, where she refused the state. Viry was charged with DUI and open container violation.
