Dalton man arrested after for DUI after leaving Mexican restaurant and weaving on the roadway

According to a Dalton Police Department incident report, On June 17th, 2023, at 3:30 AM, Officer Marcus was traveling east on East Morris Street near Lester Avenue when he observed a vehicle exiting the Taqueria El Rey restaurant at 1705 East Morris Street. The vehicle backed out of the restaurant completely into the center lane and continued to back up entering the eastbound lane. The officer then observed the vehicle weaving all over the roadway. Officer Marcus initiated a traffic stop on the vehicle and made contact with the driver, Victor Manuel Rivera-Osorio, 32, of Dalton. Officer Marcus reported, “[I] could detect the odor of alcohol coming from Victor’s vehicle. Victor had a passenger so [I] asked him to step out of the vehicle. [I] could detect the odor of alcohol coming directly from Victor. [I] asked victor if he had been drinking. Victor stated that earlier in the night he had consumed a few beers. [I] also observed that Victor’s eyes were bloodshot red. Due to the odor that [I] smelled, the bloodshot eyes, the driving that [I] observed and Victor’s admission to consuming alcohol, [I] considered that victor might be under the influence beyond the ability to safely operate a motor vehicle. During field sobriety tests, Victor showed several signs of impairment and tested positive for alcohol. Victor was transported to the Whitfield County Jail where he showed a BAC of a .021. Victor was charged with for weaving and DUI less safe.
