Cedartown man arrested for DUI after being stopped for seatbelt violation in Floyd County

According to a Floyd County Police Department incident report, March 29th, 2023, at 6:24 PM, Officer Dollar was patrolling the area of Cave Spring Road and Walker Mountain Road when she observed a blue 1995 Chevrolet K1500 truck traveling South. The driver, later identified as James Abbott, 55, of Cedartown, was not wearing his lap and shoulder belt. Officer Dollar initiated a traffic stop and made contact with James. Officer Dollar reported, “James began to give me his debit card after asking for his license again. James then realized and gave me his license. While speaking with James, [I] did detect an odor of an alcoholic beverage dissipating from James. [I] observed his eyes to be red and glassy. It should be noted that when [I] approached James this time, I observed he was eating chicken. People commonly will do this or light cigarettes/chew gum when attempting to mask an odor of alcoholic beverage from their breath. While at the front of my patrol vehicle, [I] asked James if he had consumed any beer/alcoholic beverages. He stated no. [I] advised James that [I] did detect an odor of alcoholic beverage from him. [I] again asked James if he had consumed alcoholic beverages or anything that may impair his ability to drive. He stated he was good.” During field sobriety testing, James showed several signs of impairment and a BAC of .073 on a PBT. James then admitted that he consumed only one beer with his pizza for dinner at Mellow Mushroom. James was placed under arrest for DUI and agreed to the state test. James showed a BAC of .05 on the state test. James was transported to Floyd County Jail, where he was charged with DUI Alcohol less safe, and a seatbelt violation.
