Corporal Hensley reported, “At this time, [I] observed a Chevrolet Trailblazer approaching my location very slowly. The driver of the vehicle appeared to be having difficulty following Troopers directing traffic. As [I] spoke with the driver and requested his license, [I] noted he had a cigarette that had just been lit. [I] requested that the driver put out his cigarette because the smoke was blowing directly into my face. The driver stated that he wasn’t going to do it. [I] noted that the subject’s eyes appeared watery and bloodshot, and his speech was slow and slurred. The subject was asked how much he’d had to drink, and he stated nothing and that he had just left the grocery store.” The driver, later identified as Allen Eugene Brigham Jr., 55, of Kingston, showed several signs of impairment during field sobriety testing. Once his cigarette was out, the trooper could smell the strong odor of alcoholic beverage coming from his breath. Allen was placed under arrest for DUI and agreed to the state test. Allen was transported to the Floyd County Jail, where he was charged with DUI.
