Dalton man arrested for DUI after crashing into tree on Underwood Circle

According to a Dalton Police Department incident report, On February 13th, 2023, at 11:59 PM, Officer Ellenburg responded to a call of a single-vehicle crash in the area of 1301 Underwood Circle. Dispatch advised that the vehicle, a green Honda Civic, was overturned and with possible injuries. Officer Ellenburg observed a green Honda Civic resting on its passenger side against a tree. Officer Ellenburg reported, “[I] then observed the driver (Miguel Gustavo Guzman, 19, of Dalton) sitting on the ground beside the vehicle, and he was being examined by EMS due to some bleeding he had coming from his hands and parts of his head. EMS examined him, and Miguel denied medical treatment stating that he was fine. [I] then asked Miguel if he could recall what had happened, and he stated that he believed that he had blacked out because he did not remember how the accident occurred. He just remembers waking up after the accident was over. While [I] was speaking to Miguel, [I] noticed the smell of alcohol coming from his person/mouth area. [I] also observed that Miguel’s eyes were red and glassy. [I] then asked Miguel if he had any alcoholic beverages tonight, and he stated that he had three “Mimosas” prior to the crash at a Mexican restaurant he was eating at.
During field sobriety tests, Miguel showed several signs of impairment. Miguel would ask officers questions such as “can I just drive my vehicle home?” and later at the jail asked officers what had happened, stating he “Didn’t remember that he was in an accident.” Miguel was placed under arrest for DUI and agreed to the state test. Miguel was transported to the Whitfield County Jail, charged with DUI/alcohol .08 grams or more, 21, and failure to maintain lane.
