According to a Dalton Police Department incident report, On September 16th, 2023, at 1:00 AM, Officer Warren responded to an address in reference to an alleged impaired driver on the premises. The 911 caller claimed that a neighbor was driving around the parking lot in a purple car and had possibly struck an apartment building. Officer Warren, Officer Jones, Officer Lewis, and Officer Fraire located a purple Toyota Scion parked next to the apartment. The Toyota had both heavy front and back bumper damage. We also discovered seemingly new damage to the backside of the apartment and the front side of the apartment. Officers then located the driver, later identified as Sergio Calderon, 64, of Dalton. Officer Warren also observed that Sergio’s eyes were bloodshot and that a strong odor of alcoholic beverage was coming from his breath. Sergio stated that someone had hit his car. Sergio was also observed stumbling and struggling to maintain balance as he walked with officers. During standardized field sobriety testing, Sergio showed several signs of impairment and a BAC of .150 a PBT. Sergio protested his arrest and claimed he had not driven that night. Officers then reminded Sergio that he had stated to them earlier that he had been driving the car a short time before their arrival. Sergio then stated that he was just testing the car’s battery. Officer Jones informed officers that both the caller and several witnesses had observed Sergio driving the Toyota in the parking lot, exiting the car, and struggling to walk to his apartment. Sergio was booked into the Whitfield County Jail, where he showed a BAC of .175 on the state test. Sergio was charged with DUI alcohol and leaving the scene of an accident with a fixed object x2.
