Tennessee man arrested for DUI after driving all over Battlefield Parkway while holding phone

According to a Catoosa County Sheriff’s Office incident report, On January 28th, 2023, at 6:06 PM, Lieutenant Cantrell was traveling eastbound on Battlefield Parkway behind a 2001 Toyota 4Runner when he observed the vehicle driving all over the roadway, failing to maintain a single lane. According to the report, While sitting at the LaFayette Road red light, Lt. Cantrell could see through the back window that the driver, later identified as Cody J Smith, 46, of Hixson, TN, was holding his phone in his hand and appeared to be talking to someone. Once the light turned Green, Lt. Cantrell initiated a traffic stop and made contact with Smith. According to the report, “Lt. Cantrell could smell a strong odor of alcoholic beverage emitting from Smith’s breath and also observed the Smith’s eyes to be bloodshot and watery. Lt. Cantrell asked Smith if he had consumed any alcoholic beverages on this date, and he advised he had not. He stated he had not consumed a single drop of alcohol on this date. As Smith spoke to Lt. Cantrell, his words were slurred, and his thought process appeared to be slow as he responded to questioning.” During standardized field sobriety testing, Smith showed several signs of impairment and a BAC of .230 on a PBT. Smith was placed under arrest for DUI and refused the state test. Smith was then transported to the Catoosa County Jail, charged with DUI, open container violation, hands-free violation, and failure to maintain a single lane.
