Rocky Face man found DUI after traffic stop for failing to maintain lane in Whitfield County
According to a Whitfield County Sheriff's Office incident report, on September 25th, 2020, at approximately 10:15 PM, A deputy was patrolling the area of Highway 201 at Lafayette Road when he noticed a Toyota Tacoma with its high beam headlights on. The vehicle failed to dim its high beam headlights as the vehicle passed the deputy's patrol vehicle. When the deputy got behind the vehicle on Highway 201 near Gordon Springs Road, he observed the vehicle fail to maintain its lane. The movement over the right fog line was very sudden and occurred three separate times, the deputy reported. The deputy stopped the vehicle and made contact with the driver, Morgan Elrod, 20 of Rocky Face, and front-seat passenger, Molly Smith, 20 of Summerville. Elrod produced a Krispy Kreme gift card and handed it to the deputy instead of his driver's license. The deputy smelled a strong odor of alcoholic beverages emitting from the vehicle. When the deputy asked Elrod how much alcohol he had been drinking, Elrod replied, "not much at all, my friend." The deputy observed Elrod's eyes were bloodshot and smelled a strong odor of alcoholic beverages emitting from him. The deputy noticed Elrod stumble multiple times as he walked. When asked again about how much alcohol he had been drinking, Elrod stated he had a couple of shots of vodka. Elrod agreed to participate in Standardized Field Sobriety Testing. Mr. Elrod stated he would participate in the tests. Elrod showed many clues of impairment during the Horizontal Gaze Nystagmus test. He also showed many signs of impairment during the walk and turn test and the one-leg stand test. Elrod was placed under arrest for DUI. The deputy read Elrod Implied Consent Notice for Suspects Under Age of 21, where Elrod agreed. The deputy spoke the passenger where he smelled an odor of alcoholic beverages emitting from her person. The deputy also observed Smith's eyes were bloodshot and observed her stumble several times. Smith stated to the deputy that she had been drinking alcoholic beverages. Smith being 20 years of age at the time of the encounter, was cited for underage consumption. Elrod was transported to the Whitfield County Jail charged with failure to dim, failure to maintain lane, and driving under the influence of alcohol under 21 years old. Elrod's blood alcohol content was 0.160 grams when he took the breath test.
