Dalton man arrested for DUI after early morning traffic stop for driving with no headlights on
According to a Dalton Police Department incident report, on January 23rd, 2020, shortly after 2:00 AM, an officer was traveling west on West walnut Ave. When he observed a dark-colored SUV traveling east on West Walnut Avenue with the headlights turned off. The officer attempted to conduct a traffic stop on the vehicle, which continued eastbound on w walnut ave until finally stopping approximately 4 miles down the road at East Willow Park Drive. The officer made contact with the driver, Jorge Alberto Avila, 34, of Dalton, he could detect a strong odor of an alcoholic beverage coming from inside the vehicle. Jorge stated that he had drunk approximately 2 or 3 beers. He then stated that the 2 or 3 beers he had drunk were earlier in the night, though. The officer asked how long ago it was, and he stated approximately two hours prior. The officer decided to have Jorge perform standardized field sobriety tests to see if he was safe to drive. Jorge showed many clues during the tests displaying that he was DUI. The last test that the officer explained and demonstrated to Jorge was the field Alco-Sensor test. Prior to having Jorge blow into the Alco-Sensor, Jorge stated without any questions asked: "I'm pretty f***ed up." During this test, Jorge showed a breath alcohol content of.141. Jorge was placed under arrest for driving under the influence of alcohol (DUI) and read Georgia's Implied Consent notification at the scene. Another officer found a 12 pack of beer with multiple missing and a "Tallboy" in the center console. Jorge was transported to the Whitfield County Jail, where he gave a breath sample on the Intox 9000 machine and showed a blood alcohol count (BA) of .136 and .125 grams of alcohol. Jorge was cited for DUI .08 grams or more and no lighted headlights.
